My husband is currently working at a motel 6 he is the up keep of maintenance man there. He have been there 14 months, when he first started there he was able to get at least 60-70 hours which is already not good when you only making 8.25 and hour, anyway recently the indians came and brought into the motel 6 where he is working and their hours dropped from 60-70 hours to 32 hours every two weeks…yes my husband bought home maybe 152.00 every two weeks.He have put in applications everywhere he could but no luck so he decided to stick out there and pray that things get better for him. It was two of them out there but one of them got fed up and quit what you think happened then? Yep they gave him the hours that the the other man had which was good up until he had him doing things that it took two men to do like taking those big long AC units out and replacing them with new ones and moving dressers and more. To make a long story short since they took over my husband been Catching it, So this morning his supervisor came to him and said that he is about to cut his hours down to one to two days with only 5 hours because found another man that will do the job cheaper, come on 8.50 an hour well come to find out it is the boss cousin and he just want my husband to work the mans off days. My husband told him to just lay him off and he said no because he might need him. So what motel 6 is got is someone that will probably work 70 hours a week for 6.00 (just guessing) and my husband to work 2 days so the man that's working cheaper can get off days, can this be reported to someone? Is this legal. For one they is like forcing my husband to stay on a job and waste his gas going those few days and couple hours the way the job market is here there is no telling when he will be called for another job and we are in the hole right now. I work but I dint make enough to run a household of 6 by myself.
Have him file for unemployment…….then he can tell his story to the judge………see what happens……..
if you are in the US there is absolutely nothing illegal in what this employer has done
(at least considering the "facts" you have presented)……..
why was your husband bringing home so little?
even at 32 hours a week and $8.25 an hour he should have brought home at least $185.00 a week (not much but a lot more then you say he brought home in 2 weeks).
how many dependents does he claim?
does he have insurance being deducted for?
if your husbands hours have been cut as much as you state he may be able to draw benefits under unemployment insurance, this is commonly called under-employment.
he needs to file and see if he qualifies, that is the only way to know for sure.
Unfair though it might be, they can legally hire the boss's cousin and give him some of the hours your husband would have had, although federal minimum wage iw $7.25 so they can't legally pay the cousin less than that - but that's between them and the cousin.
They aren't forcing your husband to work for them, although until he finds something better he might as well stay with them. But with the drastic reduction in hours, he might qualify for unemployment - check that out with your local unemployment people.
