I have lived in the property for over a year and the landlord has not made necessary repairs such as my front door being problematic and insecure since move-in, my back door won't up, some electrical outlets are inoperable . Recently there was a leak inside the walls which plumbers had to open up wall and fix. Now the landlord won't fix dry wall which causes draft and problems with my stove. After requesting she fix these things she gave me a 30day notice to move out…informing me that she could no longer keep up with property and has been in default for months on the mortgage payment. I withheld rent and now she is suing me…Is that legal??
yes and no she can sue you for with holding rent …… but if you with held the rent the legal way such as brining it the your local court house telling them the reason in your case things bot being fixed and they will hold the rent until action the by land lord has been made . if you with held the rent by you holding on to it yes she can sue you.

You can counterclaim. Counter-Sue her in her lawsuit. It's NOT legal to withhold rent according to most leases, or in most states, but judges will usually force some compromise.
Hope you have some proof of requests to LL to fix items. Collect all your emails, notes, whatever, create a chronology of items needing fixed and your requests for her to do so.
In most places, you cannot simply withhold rent because repairs haven't been made. There are procedures you would have needed to follow (these vary depending on where you live), possibly including having a city inspector visit, submitting repair requests in writing via certified mail, and/or going to court and paying rent to an escrow fund that the landlord cannot receive until repairs are made. You owe back rent so you need to pay it.
Everything she has done is legal. A 30 days notice is legal unless you are in the middle of a lease. She did not have to have a reason. You had NO RIGHT to withhold rent!! THAT was ILLEGAL and she had every right to sue you for it.
You did not move out so your landlord is entitled to the rent you owe. It is not legal to withhold rent for repairs not made. She told you she could no longer keep up with the property. It wouldn't be a bad idea to think about moving.
Yes, it is legal for her to sue for rents. You owe the rents because you occupied the premises. Lack of repairs does not remove the responsibility to pay. Pay up and move out when you can.
While this isn't legal advice and local laws are going to differ from place to place, you should win if you follow through. The front door, back door and electrical problems may make the property uninhabitable so you had the right to withhold to the extent of the cost of repairs. (Note, some localities let you withhold all the rent for uninhabitability, while others allow you only to withhold the amount that you spent to repair the uninhabitable condition.) If your city has a housing inspector, you should request an inspection. Otherwise, document the conditions in writing to the LL, take pictures, and keep copies of all the back-and-forth. You have to show up to contest the eviction and suit for back rent. Good luck!
